By voluntarily providing your phone number to NKPM in any channel (including web forms, email, phone, text, or paper applications), you expressly authorize NKPM to contact you by:

• Telephone calls, including from automated or AI-assisted dialing systems
• PrerRecorded or automated voice messages where permitted by law

• Tenant placement and leasing timelines, showing confirmations, and status updates
• Application, screening, or lease-approval communications
• Maintenance and work-order scheduling, updates, and completion confirmations
• Rent due reminders, late-payment notices, and payment confirmations
• Owner disbursement notifications and accounting updates
• Portal setup, password reset, and account security notifications
• Emergency or urgent safety notifications and access instructions
• Marketing and promotional messages about NKPM services and listings
• Surveys, experience feedback, and service-quality follow-ups

4. Message Frequency & Charges

Message frequency will vary based on your relationship and activity with NKPM (for example, more frequent during active leasing, maintenance, or renewal processes). You are responsible for any charges assessed by your carrier for SMS/text, data, or voice usage.

5. No Guarantee of Outcomes

While NKPM aims to deliver high-quality services and proactive communication, we do not guarantee specific outcomes, including but not limited to:

• Timeline for tenant placement or vacancy duration
• Approval or denial of any rental application
• Property performance, occupancy rates, or cash flow results
• Vendor response times beyond agreed service levels
• Uninterrupted availability of websites, portals, or communication channels

6. Intellectual Property

All content on NKPM websites and materials—including text, graphics, logos, icons, documents, proposals, pricing tables, photographs, and the “Next Key Property Management” brand—are the property of NKPM or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from NKPM content without our prior written permission, except for limited personal use in connection with our services.

7. Third-Party Platforms & Links

NKPM may use and provide access to third-party platforms such as DoorLoop, payment processors, vendor management tools, and other partner systems. Our site may also link to external websites.

NKPM is not responsible for the content, practices, or privacy policies of third-party sites or platforms. Your use of those services is subject to each provider’s terms and policies.

8. Disclaimers

NKPM sites and services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or availability.

We do not warrant that the site, portals, or communications will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, NKPM, its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or related to:

• Your use of or inability to use our sites, portals, or services
• Any errors, omissions, or inaccuracies in information provided
• Vendor actions, omissions, or service performance
• Tenant or third-party behavior or non-compliance
• Unauthorized access to or use of your account or data

In all cases, NKPM’s total liability for any claim arising under these Terms will be limited to the amount, if any, you paid us for the specific service giving rise to the claim during the 12 months preceding the event.

10. Indemnification

You agree to indemnify, defend, and hold harmless NKPM and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

• Your use of NKPM sites, portals, or services
• Your violation of these Terms
• Your violation of any third-party rights
• Your misuse of NKPM communications, content, or systems

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Maryland, together with applicable federal law, without regard to conflict-of-law principles. Any dispute arising under or relating to these Terms or your use of NKPM services will be subject to the exclusive jurisdiction of the state and federal courts located in Maryland.

13. Relationship to Management Agreements & Leases

These Terms are separate from, and in addition to, any written property management agreement, lease, or addendum you may sign with NKPM or the property owner. In the event of a conflict between these Terms and a signed agreement, the signed agreement will control with respect to the subject matter of that agreement.
